Terms of Service

Effective October 12, 2026

Please read these terms carefully. They include an agreement to resolve disputes through individual arbitration and a waiver of class actions (see "Disputes and arbitration"), as well as limits on our liability. By creating an account or using ATL Thrift Guide, you agree to these terms.

These Terms of Service ("Terms") are an agreement between you and Cheyenne Joyce (2nd Studio), who operates ATL Thrift Guide ("ATL Thrift Guide," "we," "us"), covering your use of the ATL Thrift Guide app and website (the "Service"). Our Privacy Policy explains how we handle your information.

1. Who can use the Service

You must be at least 16 years old to create an account. By using the Service, you confirm that you meet this requirement and can form a binding agreement. You're responsible for keeping your login secure and for activity on your account.

2. Membership and payments

Creating an ATL Guide Member account is free. Right now, every member gets all of the Service's features, including curated events and saving stores and routes, and there are no payments of any kind in the Service. We may add, change, or remove features at any time, and we may offer paid features in the future. If we do, they'll be sold only through Apple's in-app purchase, and we'll update these Terms and ask you to agree again before anything is charged.

If we ever offer paid features, they'll be sold only through Apple's in-app purchase system, and billing, renewals, cancellations, and refunds for those purchases will be handled by Apple under Apple's terms. Before that happens, we'll update these Terms and our Privacy Policy and ask you to agree to them again.

3. Store, event, and route information

ATL Thrift Guide is an informational guide. We don't own, operate, or control the stores, sales, markets, or events listed, and we aren't responsible for them, their products, their prices, their conduct, or anything that happens at them. Store hours, addresses, prices, event details, and routes may be inaccurate or out of date; always confirm with the business or organizer before you go. Travel times and directions are estimates. You're responsible for your own safety, travel, and purchases.

4. Your content

You own the content you post, such as finds, photos, comments, and event submissions ("Your Content"). By posting it, you give us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, adapt (for example, resizing photos), and distribute Your Content to operate, improve, and promote the Service, including sharing published events on our social media. This license ends when you delete the content or your account, except for content that was shared with others or published as community information, such as events.

You're responsible for Your Content and confirm that you have the rights to post it, including any photos, and that it doesn't violate anyone's rights or any law.

5. Community rules

When using the Service, you agree not to:

We have zero tolerance for objectionable content or abusive users. We review reports within 24 hours, remove content that breaks these rules, and remove the accounts of people who post it. We may also review, remove, or decline any content, and suspend or close accounts that break these Terms, at our discretion. The app also won't accept finds, comments, usernames, bios, or events that contain certain offensive words.

You can report content or block people from within the app: tap Report / Block on any find or comment, or Report this event on an event.

6. Our content

The Service, including our curated store guides, event listings, routes, design, and branding, belongs to us or our licensors and is protected by law. We give you a personal, non-transferable permission to use the Service for your own non-commercial use, subject to these Terms.

7. Ending your account

You can delete your account anytime in the app (Profile → Delete account). We may suspend or end your access if you break these Terms or if we stop offering the Service. Sections that by their nature should continue (such as content licenses for published events, disclaimers, limits of liability, indemnity, and disputes) survive after your account ends.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DON'T GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION IN IT IS ACCURATE OR CURRENT.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ATL THRIFT GUIDE AND ITS OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE, ANY STORE OR EVENT LISTED IN IT, OR ANY CONTENT POSTED BY OTHER USERS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50. SOME PLACES DON'T ALLOW CERTAIN OF THESE LIMITATIONS, SO THEY MAY NOT ALL APPLY TO YOU; IN THAT CASE, OUR LIABILITY IS LIMITED TO THE SMALLEST AMOUNT ALLOWED BY LAW.

10. Indemnification

You agree to defend, indemnify, and hold harmless ATL Thrift Guide and its operator from any claims, damages, losses, and costs (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms or anyone's rights.

11. Disputes and arbitration

Talk to us first. If you have a concern, email info@atlthriftguide.com. Most issues can be resolved quickly, and you agree to try to resolve any dispute informally for at least 30 days before starting a formal proceeding.

Binding individual arbitration. If we can't resolve it, you and we agree that any dispute arising from or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. The arbitration will take place in Fulton County, Georgia, or remotely, and the arbitrator's decision may be entered as a judgment in any court with jurisdiction.

No class actions. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL.

Opting out. You can opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@atlthriftguide.com with your account email and a clear statement that you're opting out of arbitration.

If the class action waiver is found unenforceable for a particular claim, that claim will be decided in court, not arbitration.

12. Governing law

These Terms are governed by the laws of the State of Georgia and applicable federal law, without regard to conflict-of-law rules. Subject to the arbitration section, any court proceeding will take place in the state or federal courts located in Fulton County, Georgia.

13. Apple

If you downloaded the app from the Apple App Store, these Terms are between you and us, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide support for it, and isn't responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you aren't located in a country subject to U.S. government embargo and aren't on any U.S. government list of prohibited or restricted parties.

14. Changes to these Terms

We may update these Terms. If changes are significant, we'll notify you in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

15. Other terms

If any part of these Terms is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver of it. You can't transfer these Terms without our consent; we may transfer them as part of a business transfer, such as moving the Service to a company we form. These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
